*TERMS & CONDITIONS – DDP PROPERTY REFER A FRIEND OR FAMILY MEMBER REFERRAL PROGRAM

 This offer is only available to individuals who are subscribed to receive DDP Property electronic newsletters and marketing communications. Applicable for all referrals made before 31 December 2020.

To be eligible for the ‘refer a friend or family member program’, the referred DDP Property database member’s ‘friend’ or ‘family member’ must sign up as a new Client to DDP Property and pay the DDP Service fee and follow the new Client DDP Property process. The referring party will receive a bank deposit of $1,000 AUD to their nominated bank account, no later than 14 days AFTER the referred party’s property settlement date.

The referred party must be a new Client to DDP Property and have not purchased from DDP Property in the past.

1. This offer is valid from 10 November 2020 (“Start Date”) until 31 December 2020 (“End Date”) (collectively, “the Promotion Period”).
2. This offer involves a $1,000.00 (one thousand dollars) AUD referral payment to persons that successfully refer a client to DDP Property during the Promotion Period.
3. The referral payment is paid for each client that is referred, with no maximum amount set of persons that can be referred (i.e. one person successfully referred equals a $1,000 referral payment; two persons successfully referred equals a $2,000 referral payment).
4. To be eligible to receive this offer, the referrer must:
   a. Be over the age of eighteen years.
   b. Have completed the form on the electronic direct mail communication  c. Referred friends must be new clients to DDP Property and must not have contacted DDP Property previously, been contacted by DDP Property previously or currently in contact with DDP Property.
   d. Have obtained the consent of the person they are referring to provide their details to DDP Property.
5. The $1,000 referral payment will be paid within 14 (fourteen) days to the referrer AFTER the referred customer’s property settlement date. A property settlement date is defined as: Property settlement is a legal process when ownership passes from the seller to the referred client), and where the Client pays the balance of the sale price.
6. You must not promote or market this offer through any paid advertising channels or to the public at large.
   a. You must disclose to your friend or family member about the existence of this offer when engaging in the referral.
   b. You must not make any representations about DDP Property’s service / product that is outside of your knowledge. DDP Property holds no liability for any representations made by third parties that have not been approved by DDP Property.
7. All ancillary costs associated with redeeming the offer are the responsibility of the referrer. Independent financial advice should be sought by the winner as tax implications may arise as a result of accepting the offer.
8.  This offer is a promotional offer only and is not to be considered as an engagement of employment or otherwise.
9.  DDP Property reserves the right to alter or amend the conditions associated with this promotion if considered necessary, without notice.
10.  Referral rewards will only be paid to the first person who made the referral, in the case of the same person being referred.
11.  Entry into this program is acceptance of these terms and conditions.
12. You agree that “Spamming” other individuals to join the Service via unsolicited email, direct mail, newsgroups, message boards, or any other means is strictly prohibited for the referral program. You agree that you will only make direct referrals without using any merchant site, keyword bids, black hat SEO, paid advertisements (e.g., pay per click), or other similar methods. You agree that any referral made by you will be done without use of i-frames, bots, or any other method of automated distribution. You agree that you will comply with all applicable laws and regulations, including without limitation those related to the Spam Act 2003 (Cth), trademark, and privacy. Any referral content used by you in association with the Unique Referral Link will not include inappropriate content, such as hate, porn, violence, or other similar content that we determine in our sole and absolute discretion could be expected to negatively impact our goodwill or reputation. We reserve the right to remove you from participating in this promotion if we determine in our sole and absolute discretion that you have violated any of these restrictions, and at such time you agree that you will forfeit all Referral Bonuses, including by offset against Pending Earnings or Available Earnings if previously paid, in addition to any other rights or remedies that we may have at law or in equity.

13. REFERRALS – Subject to your compliance with the terms of this Agreement, DDP Property shall pay you a referral fee to your personal bank account (“Referral Fee”) if you meet the Referral Program requirements (as in force at that time) in Australia.

14. PROHIBITED USES

You may only use our Referral Program for lawful purposes and if you act in good faith. You may not:

(a) create more than one account in order to invite yourself;

(b) invite others that have created, or may create, duplicate accounts;

(c) use alternative contact information to refer yourself or others that have created duplicate accounts;

(d) invite members that you do not know personally, if you do so in a way that constitutes spam or other undesirable or unsolicited communications;

(e) invite an existing customers of DDP Property

(f) invite fictitious persons;

(g) do anything that damages DDP Property’s brand, goodwill or reputation;

(h) use the Referral Program in: (i) any way that breaches any applicable local, national or international law or regulation; or (ii) any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

(i) transmit any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or

(j) otherwise attempt to circumvent this Agreement or the Referral Program.

Any obligation on you not to do something includes an obligation not to allow that thing to be done.

15. DATA PROTECTION – You represent and warrant to us that you have obtained the express consent from the individuals whose data you provide us with.

16 ABUSE OF THE REFERRAL TERMS – DDP Property has the right to refuse to pay you the Referral Fee if (in its sole and absolute discretion) DDP Property suspects that you have not used the Referral Program in good faith or have breached any term or condition of this Agreement.

DDP Property will determine, in its sole and absolute discretion, whether there has been a breach of this Agreement. When a breach of this Agreement has occurred, DDP Property may take such action as it deems appropriate, including (but not limited to) termination of this Agreement, closing your account(s), closing third party account(s) and suspending the Referral Program.

LIMITATION OF LIABILITY – DDP Property accepts no liability for any use of the Referral Program which does not comply with this Agreement.

17 .CHANGES TO THIS AGREEMENT – We may revise this Agreement at any time by amending this page. Continued use of the Referral Program shall amount to acceptance of the Agreement in force at that time.

18. CHANGES TO THE REFERRAL PROGRAM

DDP Property reserves the right to:

(a) amend, alter or change the Referral Program at any time, without notice; and

(b) terminate the Referral Program at any time, without notice. In the event the Referral Program is terminated, DDP Property will not be obliged to provide a benefit to any account that would have otherwise qualified for Referral Fee.
